Elopement Photography Agreement

This agreement is between The Sassenachs (Photography) Limited, trading as The Sassenachs, company number SC884974, 3 Victoria Terrace, Crieff, PH7 4AA (“the Photographers”, “we”, “us”) and the couple named in the booking (“the Clients”, “you”). By booking our services, you agree to the following terms and conditions.

Your elopement

• Date: the date in your booking
• Where: the location in your booking
• Package and price: as shown when you book

Instant booking

When you book online and your payment goes through, your booking is confirmed and your date is yours. For Midhope Castle, we also confirm the date with the estate: if they cannot do it, we will offer you another date or location, or refund everything you have paid in full.

Pre-elopement catch-up

We insist on a pre-elopement catch-up about one month before your elopement. We go through the plan, the timings and anything still to sort, so the day itself runs smoothly. We’ll arrange a time with you.

Payment and Deposit

25% deposit when you book. The balance is due 8 weeks before your date, and we’ll send reminders. If your date is less than 8 weeks away when you book, you pay in full at booking. You can always choose to pay in full.

Non-payment of the balance may result in services being withheld. If you cancel, see Your right to cancel and Cancellation and Amendments below.

Sharing your photographs

We own the copyright in your photographs and you get a full personal-use licence (print anywhere, share anywhere). We’d love to share some of them on our website, social media, in print and in competitions, and unless you tell us otherwise, we may. Your questionnaire has a “Happy for us to share your photos?” question: choose “Ask us first” or “Keep them private” and we’ll stick to it. You can change your mind at any time by emailing us, and we’ll take your images down from anything we control within 30 days. We’ll never use your images in a way that feels disrespectful or out of context.

Delivery of Images

Image sizes are approximate. We provide a pleasing colour balance but cannot guarantee exact colour matching, as screens and print processes differ.

Our editing style and artistic judgement are part of our signature. Once delivered, images cannot be rejected or re-edited for reasons of style or composition.

We do not guarantee a set number of images, as circumstances vary, but we always deliver the full story of your day. The number delivered is final.

Edited galleries are delivered within 8 to 12 weeks of your wedding or elopement.

Weather Conditions

Scottish weather is unpredictable. The final aesthetic of your images will reflect the conditions on the day. We’ll advise the best time to shoot, but if you choose a different time, we cannot be held responsible for how the light affects your images.

Force Majeure

If we are unable to attend due to circumstances beyond our reasonable control (illness, accidents, road closures, flooding, crime, etc.), we will make every effort to connect you with another photographer, but this cannot be guaranteed.

If we must cancel, all fees paid to us will be refunded within 7 days. In the extremely rare event of total image loss, our liability is limited to the fees paid to us. This doesn’t limit any liability that can’t be limited by law.

Image Storage

RAW images are kept for 6 months after your event. Edited images are stored for 12 months.

Online Gallery

Your full high-resolution gallery will be available online for 12 months. Please download and safely back up your images within this time, as we cannot guarantee storage beyond it.

High-Resolution Images and Print Release

You are welcome to print your images for personal use. Please note that we cannot guarantee print quality from third-party labs. For best results, we recommend ordering prints directly through us.

Your right to cancel

Because you’re booking online, you have a legal right to cancel within 14 days of booking, for any reason, and we’ll refund everything you’ve paid within 14 days of you telling us. Just email hello@thesassenachs.co.uk, or send us the form below. If your elopement is less than 14 days away when you book, you’ll have asked us to start work straight away, so this right ends once your elopement has happened. After the 14 days, the cancellation terms below apply.

Cancellation and Amendments

After your 14-day right to cancel has passed:

• Your deposit is non-refundable. It holds your date, which we turn other couples away from, and covers the planning we start the moment you book.
• If you cancel within 8 weeks of your elopement, the full balance is due. By then we’ve turned the date down to everyone else and can’t realistically rebook it. If we do manage to rebook it, we’ll refund what you paid beyond the deposit.
• We will try to move your date instead, within 12 months, subject to availability, but this can’t be guaranteed. Any price difference for the new date or location is payable.
• We strongly recommend wedding insurance to protect against unforeseen cancellations (e.g. flights).

Travel Delays and Missed Shoots

If you miss your scheduled shoot due to travel delays, illness, or other personal circumstances, this will be treated as a cancellation. We will do our best to reschedule, subject to availability, but this cannot be guaranteed and additional fees may apply.

Raw Files

We do not provide RAW files under any circumstances. Only carefully edited final images are delivered, as RAWs are unfinished and not representative of our work.

Client Conduct

We reserve the right to withdraw services without refund in cases of abusive behaviour, harassment, or unsafe working conditions created by clients or guests.

Personal Safety

We’ll always choose safe and beautiful locations, but Scotland’s terrain can be uneven and weather unpredictable. You’re responsible for your own decisions on the day, like footwear, how far you walk and whether to go ahead in bad conditions, so please wear suitable footwear and clothing. Nothing in this agreement limits our liability for death or personal injury caused by our negligence, or anything else that can’t be excluded by law.

Visas and Marriage Licences

You are solely responsible for securing all necessary visas and marriage licences. We cannot provide assistance with forms or applications. If a licence or visa is refused, no refunds will be given.

Complaints

If something’s not right, email hello@thesassenachs.co.uk and we’ll come back to you within 5 working days.

Governing Law

This contract is governed by the laws of Scotland, and any disputes will be resolved under Scottish jurisdiction.

Photography Services Agreement

We will provide photography services on the date in your booking at the location in your booking, for the package and price shown when you book.

2. Payment

3. Rescheduling & Weather

Scotland is Scotland. If weather makes the shoot unsafe or unshootable, we reschedule together at no cost: your payment transfers in full to the new date. You may reschedule once free of charge with 14+ days notice.

4. Your right to cancel

Because you’re booking online, you can cancel within 14 days of booking, for any reason, and we’ll refund everything you’ve paid within 14 days. If your session is less than 14 days away when you book, you’ll have asked us to start straight away, so this right ends once the session has happened.

5. Cancellation

After your 14-day right to cancel has passed: cancel 8+ weeks before your session and anything paid beyond the 25% deposit is refunded. The deposit holds your date and covers our planning. Inside 8 weeks, payments are non-refundable, as we’ve turned the date down to others by then, but we’ll always try to rebook the date, and if we do, we’ll put it towards a future session.

6. Image Delivery

Sneak peek within 72 hours; full edited gallery within 4 weeks of the session.

7. Copyright & Sharing

We retain copyright; you receive a full personal-use licence (print anywhere, share anywhere). We may share images on our website/social media unless you choose “Ask us first” or “Keep them private” in your questionnaire, in which case we stick to that. You can change your mind any time by emailing us and we’ll take images down from anything we control within 30 days.

8. Surprise Proposals

Where the session is a surprise, we commit to complete confidentiality until you tell us the secret is out. We won’t share any images of a surprise proposal until both of you have said we can.

9. Your data

10. Liability

Our liability is limited to the total amount paid. Nothing in this agreement limits liability for death or personal injury caused by our negligence, or anything else that can’t be limited by law. This agreement is governed by Scots law.
